2. General provisions and how the contract is made
- These Terms of Service cover every electronic commerce service in the BYB shop.
- The shop sells electronics and hardware to both consumer (B2C) and business (B2B) customers.
- The language of the contract is Hungarian and English. In the case of a conflict or a difference in interpretation, the Hungarian version prevails for performance in Hungary.
- An order placed in the shop is a contract concluded electronically, governed by the Hungarian Civil Code and the Act on electronic commerce services. The contract comes into existence when the service provider confirms the order.
3. Orders, prices and payment
- Prices: The prices shown on the site include VAT as required by law (gross prices), or the net and gross values are clearly marked. The delivery charge is added to the total at checkout, when the delivery method is chosen.
- Payment methods: Online card payment on the Viva.com payment page, bank transfer in advance, or cash on delivery where the chosen delivery method allows it. Card details are collected by Viva.com on its own page and never reach the service provider. The checkout itemises the amount payable before you confirm.
- Invoicing: The service provider issues an electronic invoice through the szamlazz.hu (KBOSS.hu Kft.) system and sends it to the email address given by the customer.
4. Delivery terms
- Storage, packing and preparing the ordered products for dispatch are done by the service provider in its own warehouse (1 Mihály Dénes utca, 2151 Fót).
- Delivery is carried out by the following courier partners: GLS (home delivery, GLS ParcelShop and GLS locker), FOXPOST parcel locker, and for international delivery within the European Union DHL.
- The delivery methods on offer depend on what is in the cart: for products over the size or weight limit (PC cases, for example) locker and pick-up point delivery are not available, those can only be ordered with home delivery.
- Delivery times depend on product availability and on the courier chosen; the estimate is shown during the order.
- The detailed terms of packaging, delivery charges, processing times and unclaimed parcels are set out in the Delivery policy .
5. Right of withdrawal (B2C and B2B)
- Right of withdrawal for consumers (B2C): Under Hungarian Government Decree 45/2014 (II. 26.), a customer who qualifies as a consumer (a natural person acting outside their trade, self-employment or business) may withdraw from the contract without giving a reason within 14 days. The period runs from receipt of the product.
- Businesses (B2B) excluded: Under the Hungarian Civil Code, persons acting within their trade, self-employment or business (companies, sole traders, legal entities) do not qualify as consumers, so the 14-day right of withdrawal does not apply to them.
- How to return an item: On withdrawal the product must be returned to the logistics address of the service provider only: 1 Mihály Dénes utca, 2151 Fót. The service provider cannot accept parcels sent to the registered office (2161 Csomád). The cost of the return is borne by the customer.
6. Warranty and guarantee
- Warranty of conformity and product warranty: Consumers have the warranty rights provided by law. For B2B customers the general warranty rules of the Hungarian Civil Code apply, with a shorter limitation period (1 year).
- Statutory guarantee: For durable consumer goods the statutory guarantee under Hungarian law applies to consumers (B2C) only, in the value-based bands. There is no statutory guarantee for businesses (B2B), unless the manufacturer provides a voluntary warranty for the product.
7. Remedies and complaints
- A Vásárló panaszaival az info@byb.hu e-mail címen vagy a +36 30 611 6887-es telefonszámon fordulhat a Szolgáltatóhoz.
- In a consumer dispute the consumer may turn to the conciliation board of their place of residence or to the consumer protection authority. In B2B disputes the parties seek an amicable settlement; failing that, the Hungarian courts with jurisdiction over the seat of the service provider have competence.
